GAMBIA: POLICE ASK FOR ADJOURNMENT IN PUBLICATION OF NUDE PICTURES/VIDEOS CASE

The Kanifing Magistrate’s Court has granted the police request for an adjournment in the matter of two ladies standing trial for publishing nude pictures/videos of another lady on TikTok.

The accused persons are facing charges related to sharing explicit content without consent. The two accused persons Maju Samba and Maimuna Jallow (commonly known as Maya) are standing trials for allegedly leaking a nude video and picture of a lady (name withheld).

Section 165 of the Criminal Code is titled “Traffic in Obscene Publications”. The charges brought against the defendants fall under Section 165 subsection (a) of the Criminal Code for unauthorized distribution of explicit content (Nude video/picture).

According to the charge sheet, Maimuna Jallow and Maju Samba at Senegambia and diverse places in the Republic of the Gambia shared the nude video/picture of a woman knowingly and intentionally through Maimuna Jallow’s Snapchat account or page, which facilitated its wide circulation.

The prosecuting officer, Commissioner Abdoulie Sanneh on behalf of the Inspector General of Police, made an application for an adjournment, submitting that they have communicated with the complainant who now wants to discuss with the defence to come to terms for an out-of-court settlement.

The application was not opposed by the defence and the court adjourned the case to 17 August 2023 and 31 August 2023.
