GAMBIA: IN THE CASE OF THE ALLEGED PIU SHOOTER, THE DEFENCE ATTORNEY SUBMITS A CLIENT PHONE LOG

The call log of the sixth prosecution witness has been presented to Justice E. Jaiteh of the Banjul High Court by defence attorney L.J. Darboe, who represents the accused PIU gunman. Ebou Sowe, the witness, attested to the fact that the call log had accurate information and that his name was subscribed to it when he was handed the document in the dock yesterday. A.M. Yusuf, the Director of Public Prosecution, objected to the document, claiming that it was computer-generated and that the DPP was relying on the Evidence Act.

He claimed that there was no connection between the documents and the call log or the certificate that verified the call log obtained from Qcell Company. Because it was signed by a legal officer at the Qcell Company—who is not a computer analyst—the DPP claimed that the two documents were not the same. Defence attorney L. Darboe acknowledged that a legal officer signed the document and said that the legal officer would handle such demands. He also made reference to the Evidence Act (EA) Attorney Darboe pleaded with the judge to accept the documents into evidence and reject the DPP’s position. Justice Jaiteh, the presiding judge, determined that the documents were relevant, the admissibility test was relevant in accordance with the Evidence Act, the call log’s admissibility had been properly examined, and the certificate complied with the Evidence Act as a result. Consequently, he overruled the DPP’s argument and entered the call record and certificate into evidence.
