As The Gambia moves forward with establishing an Anti-Corruption Commission (ACC), it is crucial to ensure the body’s independence , effectiveness , and credibility .
Here are some key considerations to prioritize:
Independence and Autonomy: The ACC must be free from political interference and manipulation. This can be achieved by ensuring the commissioners are appointed through a transparent and merit-based process, with security of tenure and protection from arbitrary removal.
Robust Legal Framework: The ACC’s mandate and powers should be clearly defined in legislation, with adequate provisions for investigation, prosecution, and prevention of corruption.
Adequate Resources: The ACC requires sufficient funding, personnel, and infrastructure to effectively carry out its mandate. This includes providing competitive salaries and benefits to attract and retain skilled professionals.
Transparency and Accountability: The ACC should be transparent in its operations, with regular reporting and public engagement. It should also be accountable to the public and parliament, with mechanisms for oversight and evaluation.
Public Engagement and Participation: The ACC should engage with civil society, media, and the public to build trust, gather information, and raise awareness about corruption issues.
Best Practices:
International Standards: Align the ACC’s mandate and operations with international standards and best practices, such as the United Nations Convention against Corruption (UNCAC).
Independent Investigation: Ensure the ACC has the power to independently investigate corruption allegations, without political interference or direction.
Collaboration with Other Agencies: Foster collaboration with other law enforcement agencies, audit bodies, and regulatory authorities to leverage resources and expertise.
By prioritizing these considerations and best practices, The Gambia can establish an effective and credible Anti-Corruption Commission that promotes transparency, accountability, and good governance.
