GAMBIA: DECEMBER COULD SEE A REFERENDUM ON A NEW CONSTITUTION

At the 2024 State of the Nation Address convened at the National Assembly yesterday, President Adama Barrow disclosed that a referendum on the new constitution is anticipated to be conducted in December 2024.

According to the president, his administration has implemented substantial legal reforms since 2017.

“We are dedicated to the introduction of a new Constitution this year and will continue to pursue it.” He stated that it is anticipated that a referendum on the new Constitution will be conducted in December 2024.

He also stated that the Ministry of Justice has been implementing the TRRC recommendations, particularly through the formulation of the Special Accountability Mechanisms Bill and the Special Prosecutor’s Office Bill.

He clarified that “these Bills are part of a broader strategy to establish a Hybrid Court, in collaboration with ECOWAS.” The Court will apply both domestic and international law to TRRC cases.

He declared that the Special Criminal Division of the High Court, which is staffed by distinguished Gambian judges, represents a significant advancement in the impartial and effective presiding of TRRC-related cases.

He stated that the Anti-Corruption Bill was one of the legislative items that was enacted in 2023. He also stated that “In addition to the establishment of robust frameworks to criminalise corrupt practices, specialised anti-corruption agencies have been fortified to effectively enforce the law on corruption.”

He also stated that the Victims Reparations Act, which is designed to offer compensation to victims of human rights violations committed during the previous regime, has been implemented.

Barrow emphasised that the Ban from Public Office Act was implemented to prevent individuals who had been convicted of corruption or associated offences from holding public office, thereby ensuring integrity and accountability in government.

He stated, “The Former Presidents Act, which was also enacted, recognises the contributions of the nation’s former leaders.” It ensures that they have a dignified post-presidential existence, while also considering the interests of the Gambian people.

“The Commission of Inquiry (Amendment) Act, 2023 is another piece of legislation that is designed to ensure justice and accountability within the government by conducting comprehensive investigations.”

The president also mentioned that there are numerous other bills that are currently being considered, including the Criminal Procedure Code Bill and the Criminal Offences Bill. Both of these bills are essential for the establishment of a more transparent and accountable society.

He also reiterated to the nation, “My government is resolute in its dedication to ensuring justice for all Gambians and upholding the rule of law as we continue to fortify our legal and judicial systems.”
