GAMBIA: JUSTICE ACHIBONGO ORDERED ATTORNEY GENERAL TO BE ADDED AS 11TH DEFENDANT IN A CIVIL SUIT FILED BY MOMODOU LAMIN JARJU

On Monday, 23 October 2023, Justice Francis Achibonga of the Banjul High Court ordered the Attorney General to be added as the eleventh defendant in the 30 Million Dalasi civil suit filed by Momodou Lamin Jarju alias Rongo against the Alkalo of Banjulding and a number of others.

Rongo was represented by Senior Attorney Borry S. Touray, while the Alkalo of Banjulding and seven others were represented by Senior Attorney Kebba Sanyang. Rongo was present in court, whereas all of the defendants were absent.

Borry S. Touray reminded the court that the stage of document identification had been reached. He informed the court that 70 documents have been identified and that 30 more must be identified and submitted.
Since the Inspector General of Police and the Director General of the Drug Law Enforcement Agency – The Gambia (DLEAG) are involved in the case, Justice Achibonga stated that they must be represented in court. Both parties consented to the addition of the Attorney General to represent the State.

This case was deferred to 13 November 2023 for further proceedings.

In 2018, Rongo filed suit against Momodou Lungs Jarju – the Alkalo of Banjulinding, Imam Yahya Bah of Banjulinding, Malang Njie, Modou Badjie, Landing Korteh, Lain Nafulou Jarju, Jarbel Ceesay, Foday Barry (a former senior officer of DLEAG), Inspector General of Police, and Director General of Drug Law Enforcement Agency – The Gambia (DLEAG).

Rongo is seeking ten million dalasi (D10,000,000) for his unconstitutional arrest and detention at the hands of the defendants and their agents. The Banjulinding resident is also seeking an additional 10 million Dalasi for his malicious prosecution for multiple offenses when the defendants and their agents knew or should have known he should not have been charged. On his third and final claim, Rongo seeks ten million Dalasi in damages for income loss resulting from his unlawful arrest, detention, and malevolent prosecution. In addition, he requests two hundred thousand dalasis for action costs.
