SENEGAL: MACKY SALL ACCEPTS THE DECISION OF THE CONSTITUTIONAL COUNCIL AND WILL ORGANISE ELECTIONS

The Constitutional Council of Senegal, by its decision No. 1/C/2024 dated February 15, 2024, annulled a law adopted by the National Assembly on February 5, 2024, which deviated from the provisions of article 31 of the Constitution . This law, identified under the number 4/2024, was deemed “contrary to the constitution”. In addition, the Council considered that Decree No. 2024-106, dated February 3, 2024, taken under this proposed law and notified to the President of the Republic, “lacks a legal basis”.

As part of this same decision, the Constitutional Council recognized the impossibility of organizing the presidential election on the date initially planned. He therefore invited the competent authorities to take the necessary measures to ensure that the election is held as soon as possible.

Reacting to this decision, in a press release, the President of the Republic officially took note of the Council’s conclusions, stressing that they are part of respect for the normal jurisdictional mechanisms of democracy and the rule of law, such as than provided for by the country’s constitution. The President affirmed his intention to fully comply with the decision of the Constitutional Council. To do this, he announced that he would immediately initiate the necessary consultations with a view to organizing the presidential election as soon as possible.
