GAMBIA: YANKUBA TOURAY ASKS THE SUPREME COURT TO RELEASE HIM

Yankuba Touray went before a five-person Supreme Court judge panel today, requesting that they reverse the Court of Appeal’s ruling, which maintained the High Court’s judgement delivered by Justice Ebrima Jaiteh.

Yankuba Touray argues in his ground of appeal that the Lower Court erred in its assessment of the prosecution’s evidence prior to rendering a verdict, and he requests that the Supreme reverse the Court of Appeal’s ruling and grant him his release.

Recall that Yankuba Touray filed an appeal against the ruling of the High Court, which had found him guilty of killing former Finance Minister Ousman Koro Ceesay and condemned him to death by hanging.

Yankuba Touray filed an appeal against the July 14, 2022, judgement rendered by Justice Ebrima Jaiteh, which found him guilty of murder and sentenced him to death.

In an appeal, he asked the justices of the Appellate Court, a panel of three, to reverse the ruling of the High Court.

Attorney A. Sissoho for the appellant (Yankuba Touray) made a brief adoption argument, pleading with the court to overturn the High Court’s decision against his client and to discharge and acquit him.

Senior State Counsel M.B. Sowe, who represented the State as the respondent, told the court that Yankuba Touray’s application should be dismissed because the High Court’s ruling was founded on solid legal principles and evidence.

The Court of Appeal of the Gambia’s President, Justice Na Ceesay Salla-Wadda, accepted the augments briefs once they were submitted and adopted, setting the date for the case’s judgement for December 13, 2022. Later, Justice Na Ceesay Sallah-Wadda confirmed Justice Ebrima Jaiteh’s ruling and denied Touray’s appeal.

Yankuba Touray made an appeal against the ruling of the lower courts when he appeared before the Supreme Court today. After being discussed, the matter was postponed.
