GAMBIA: COURT DISMISSES UDP CANDIDATE’S ELECTION PETITION

The election appeal filed by Musa Cham, the candidate representing the opposition UDP for Chamen Ward in the recent area council elections against Edrisa Ceesay and the Independent Electoral Commission, has been rejected by Chief Justice Hassan B. Jallow.
Yesterday, the Chief Justice, presiding as a high court judge, rendered a decision to reject the petition in its entirety and granted a monetary judgment of thirty thousand dalasi in favor of Edrisa Ceesay.
Justice Jallow revealed that the expenses should be resolved using the fifty thousand dalasi deposited by Musa Cham as a security measure for costs. Any remaining balance should then be refunded to Musa Cham.
The rejection of Musa Cham’s candidacy for councilor in the Chamen Ward by the Independent Electoral Commission (IEC) on April 11, 2023, is worth noting. In contrast, Edrisa Ceesay was declared as the uncontested candidate at the election conducted on April 15 of the same year. Musa Cham filed petition challenging the IEC’s decision and asked the High Court to declare Edrisa Ceesay’s nomination null and void.
